Mastercard's Terms and Conditions

Hellenic Bank Wallet's Terms and Conditions are valid as from the 27th of October 2020. Apple Pay's Terms and Conditions are valid as from the 15th of September 2020.

Definitions 
For the purpose of these Terms, the following words and expressions shall have the meanings as set out below:
"Apple" means APPLE DISTRIBUTION INTERNATIONAL, an Irish unlimited corporation, having a principal place of business at Hollyhill Industrial Estate, Cork, Ireland.
"Apple Device" means a device created by Apple which supports Apple Pay.
"Apple Pay" means the Apple platform through which you may register your Cards and make use of the Apple Wallet.
"Apple Pay Terms" means any agreement entered between you and Apple in connection with Apple Pay. 
"Apple Wallet" means a digital wallet operated by Apple in which you may register details of the   Cards and by means of which you are able to securely conduct mobile payment transactions.
"Bank" means the Hellenic Bank Company Ltd, registered with the Registrar of Companies and Official Receiver (Reg.No.HE 6771), having its registered office at Corner of Limassol and 200 Athalassas Avenues, 2025 Strovolos, P.O. Box 24747, 1394 Nicosia, Cyprus. The definition also includes its successors, assigns and any person acting on its or their behalf. 
"Basic Terms and Conditions" means the basic terms and conditions you have been provided with. These terms and conditions can also be found on the Bank's website at

"Hellenic Bank Wallet" means a digital wallet provided by the Bank in which you may register details of the   Cards and by means of which you are able to securely conduct mobile payment transactions. 
"Hellenic Bank Wallet App" means the mobile device application for smartphones in which the near field communication (NFC) technology has been incorporated and through which you may register your Cards and make use of the Hellenic Bank Wallet. 
"Hellenic Bank Wallet Contactless Transaction" means the Card transaction facilitated by the use of the Hellenic Bank Wallet through your mobile device and the Hellenic Bank Wallet App.  "Hellenic Bank Wallet Terms" means the present terms and conditions under which the Hellenic Bank Wallet shall be used. 
"Card", if you are a Hellenic Bank Wallet user, means any kind of Mastercard Cards issued by the Bank.
"Card", if you are an Apple Wallet user, means any kind of Mastercard Cards issued by the Bank. 
"Card Terms and Conditions" means the special terms and conditions you have been provided with. 
"Card reader" means a physical Card acceptance device used by a Merchant to take payments by Card, such as a Point of Sale (POS terminal) bearing the mark "contactless" and bearing a relevant "contactless" logo (please see the FAQs available on the Bank's website for more details).
"Contactless Transaction" means the Card transaction facilitated by the use of Apple Pay through your Apple Device.
"Device Account Number" means a unique number which is created during the registration process linking your Eligible Card to your Apple Device.
"Face ID" means the face recognition feature on your Apple Device. 
"In-app Transaction" means the ability of an Apple Device to facilitate the sale of a product or service via an online application.
"Merchant" means the person who agrees to accept a Card as payment for goods or services.
"Passcode" means the four to eight digits security feature that you have chosen as a password on your Apple Device.
"Personal Data" means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
 "Privacy Notice" means the Bank's notice on how personal data is processed with which you have been provided with and which can be found on the Bank's website at
https://www.hellenicbank.com/portalserver/hb-en-portal/en/personal-banking/divider/privacy-notice .
"Touch ID" means the fingerprint recognition feature on your Apple Device.

General Provisions
2.1. If you are a Hellenic Bank Wallet user:
2.1.1 The Hellenic Bank Wallet App is provided to you by the Bank. These Hellenic Bank Wallet Terms apply to the use of the Hellenic Bank Wallet App. 
2.1.2 By accepting these Hellenic Bank Wallet Terms, upon registering a Card in your Hellenic Bank Wallet, you agree to be bound by these Hellenic Bank Wallet Terms. You should read the Hellenic Bank Wallet Terms carefully together with our (i) Card Terms and Conditions, (ii) Basic Terms and Conditions and (iii) our Privacy Statement. 
2.2. If you are an Apple Wallet user:
2.2.1 The Apple Wallet and Apple Pay are provided to you by Apple. These Terms apply to the use of the Apple Pay and Apple Wallet. By using them you are governed by the Terms of Apple Pay and/or any other agreements you enter into with Apple or with any other third parties (such as your mobile, internet and/or network carrier(s) which are connected to the Apple Wallet) as applicable from time to time.
2.2.2 The Bank is not responsible for the Apple Pay Terms and/or any other agreements you enter into with Apple or with any other third parties in connection with Apple Pay and/or the Apple Pay Wallet, and the Bank will not be liable to you for the provision, functioning and security of Apple Pay and/or the Apple Pay App. 
2.2.3 Apple, Apple Pay, Face ID, Touch ID and iOS are registered trademarks, and are used under license from Apple.
2.2.4. By accepting these Terms for the use of Apple Wallet, upon registering your Card in the Apple Wallet, you agree to be bound by these Terms for the use of Apple Wallet. You should read the Terms for the use of Apple Wallet carefully together with our (i) Card Terms and Conditions, (ii) Basic Terms and Conditions and (iii) our Privacy Statement. 
2.3. These Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet are Special Terms which complement the Basic Terms and Conditions and the Card Terms and Conditions and constitute an integral part thereof. Together they govern the rights and obligations of the Bank and the Cardholder in respect of the Hellenic Bank Wallet App and/or in respect of the use of Card by Apple Pay or Apple Wallet. Terms and expressions defined in the Basic Terms and Conditions and Card Terms and Conditions have the same respective meanings when used in these Hellenic Bank Wallet Terms and/or in these Terms for the use of Apple Wallet, unless otherwise defined in these Hellenic Bank Wallet Terms and/or in these Terms for the use of Apple Wallet. In the event of any inconsistencies between these Hellenic Bank Wallet Terms and the Card Terms and Conditions, these Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet will prevail will prevail as regards the use of Hellenic Bank Wallet and the Hellenic Bank Wallet App and/or the use of Apple Wallet and Apple Pay.
2.4 The Bank has the right to amend these Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet at any time and shall notify you of any such amendment, 2 months prior to the amended Hellenic Bank Wallet Terms and/or to the amended Terms for the use of Apple Wallet coming into force, by posting such amendment on the Bank's website  and/or by sending a relevant written letter/communication and/or by Bank Mail and/or in any other way which the Bank considers appropriate each time and such communication by the Bank for amendment of the Hellenic Bank Wallet Terms and/or the Terms for the use of Apple Wallet shall be deemed to be considered as an effective way of communication of the relevant amendment to you. Every proposal of the Bank to amend the Hellenic Bank Wallet Terms and/or the Terms for the use of Apple Wallet shall be deemed accepted by you if you fail to notify your non-acceptance before the proposed effective date of the amended Hellenic Bank Wallet Terms and/or the Terms for the use of Apple Wallet. In case of non-acceptance, you are entitled to terminate the Hellenic Bank Wallet in force with the Bank and/or the Apple Wallet immediately and in any event prior to the proposed effective date of the amended Hellenic Bank Wallet Terms and/or the Terms for the use of Apple Wallet, as provided in clause 10.  

Licence- If you are a Hellenic Bank Wallet user: 
3.1. The Bank grants you a strictly personal, non-exclusive and non-transferable licence (the "Licence") to install the Hellenic Bank Wallet App, including future updates, on your mobile device and use it, with the following obligations and/or restrictions:
a) No property rights or intellectual rights are transferred to you. The Licence exclusively gives you the right to install the Hellenic Bank Wallet App on your mobile device and use it in accordance with the purposes stated in these Hellenic Bank Wallet Terms or as otherwise indicated by the Bank; 
b) The Bank reserves all rights to the Hellenic Bank Wallet App, including property rights, copyrights and intellectual property rights;
c) The trade names, marks and logos (or symbols comparable with these) of the Bank displayed on or in the Hellenic Bank Wallet App are the property of the Bank. You may not use any of these trade names, marks or logos without advance written permission from the Bank;
d) You may not alter, copy, distribute, transfer, display, publish, sell or grant a licence to the Hellenic Bank Wallet App or any information or software connected with the Hellenic Bank Wallet App; 
e) It is recommended that you always use the latest version of the Hellenic Bank Wallet App. Depending on what the update is, you may not be able to use the Hellenic Bank Wallet App until you have installed the latest version.
f) You must ensure that your mobile device's operating system is up to date.

How to register 
4.1. If you are a Hellenic Bank Wallet user:
4.1.1. In order to use the Hellenic Bank Wallet, you are required to register your Card/s through a customer authentication procedure, by requesting a One-Time Password that will be sent by SMS to your registered mobile device number, in order to complete the verification, registration and activation of any Card in the Hellenic Bank Wallet. Your mobile device must be connected to the internet. You can alternatively, activate your Cards through Customer Contact Centre at 8000 9999 (+357 22 500 500 from abroad, without charge).
4.1.2. After your registration in the Hellenic Bank Wallet App, and upon selection of the activation of the Hellenic Bank Wallet, you must follow the indicated steps which appear on the screen of your device. 
4.1.3. In case the secure lock mechanism (PIN, Pattern, Password) of the smartphone is removed, then all Cards in the Hellenic Bank wallet will be wiped out at the time of the next payment. The current payment will be declined automatically.
4.1.4. In case the user removed hers/his biometric/fingerprint data, all hers/his Cards that were enrolled in the Mobile Wallet app will be wiped out.
In order for you to be able to conduct again Hellenic Bank Wallet Contactless Transactions, you will need to register your Cards to your Hellenic Bank Wallet again as described in clause 4.1.1. above.
4.2. If you are an Apple Wallet user:
4.2.1. In order to use Apple Pay, you are required to register your Eligible Card(s) through a combined customer authentication procedure from Apple and the Bank and to: 
a) create a Device Account Number linking your Eligible Card to your Apple Device by opening the Apple Wallet following the on-screen instructions; and
b) confirm your identity by entering a one-time password that will be sent by SMS to the mobile number you registered with the Bank. Your Apple Device must be connected to the internet. In case there is no phone number registered with the Bank, you can activate your Cards through Customer Contact Centre at 8000 9999 (+357 22 500 500 from abroad, without charge).
4.2.2. In case the secure lock mechanism Passcode of the Apple Device is removed, then all Cards in the Apple Wallet will be wiped out at the time of the next payment. 
4.2.3. In order for you to be able to conduct again Contactless Transactions by Apple Wallet, you will need to register your Cards to your Apple Wallet again as described in clause 4.2.1. above.
4.2.4. You must ensure that only your biometrics are registered for Touch ID and Face ID. If the biometrics of a third party are registered for Touch ID and Face ID on your Apple Device, you will be deemed to have consented to the use of your Card via Apple Pay by that third party and in accordance with the Cards Terms and Conditions and you will be responsible for any transaction carried out via your Apple Wallet by non-authorised parties whose biometrics were stored in your Apple Device.
4.2.5. If you change your Apple Device and you wish to continue using Apple Pay you must deactivate your Eligible Card(s) from your existing Apple Device and register for Apple Pay on your new Apple Device.
4.2.6. You acknowledge that you are solely responsible for the accuracy of the data provided when you sign up to use your Card through Apple Pay when an Apple Pay transaction is authorized.
4.2.7. Upon your registration to Apple Pay, the Bank:
 a) will process your Personal Data in order to allow your Eligible Card to be used for Apple Pay;
 b) will collect Personal Data about you from Apple in order to confirm your identity, to check your eligibility for Apple Pay and to help prevent fraud;
 c) shares anonymised information relating to your Apple Pay transactions with Apple in order to improve and develop its technology; 
d) will provide you with your recent Apple Pay transactions as displayed on your Apple Device for your convenience. You can turn this display off at any time within Apple Pay.

Using your Card via Apple Pay
5.1. When you use your Card via Apple Pay, you must comply with the applicable provisions of the Basic Terms and Conditions and the Cards Terms and Conditions. Without limitation to the generality of the above, when you use your Card via Apple Pay, you must not:
a) Use it to do anything illegal;
b) Use it in a way that could damage the Bank’s or Apple’s systems or other Apple Pay users;
c) Do anything that the Bank or Apple tell you not to;
5.2. The Bank, payment networks or Merchants may establish transaction limits from time to time in their own discretion. This may mean that you are unable to complete a transaction that exceeds these limits when you use your Card via Apple Pay. 
5.3. You have the ability via the Apple Wallet to make purchases with your Card wherever Apple Pay is accepted. Apple Pay may not be available for all purchase amounts or at all Merchants where your Card is accepted.
5.4. The Bank may allow you to add the same Card to multiple Apple Devices.
5.5. Your Apple Device provider may impose limitations or restrictions to Apple Pay or have minimum software and hardware requirements.

Security
6.1.  You shall, as applicable:
a) use all reasonable efforts to protect the confidentiality of your Mobile Phone and/or Apple Device authentication method; 
b) maintain the confidentiality of any information shown or stored on your Apple Device in connection with the use of your Card(s) via Apple Pay including the Passcode, Touch ID and Face ID;
c) not use an out-dated version or an unauthorised modification of iOS;
d) delete all information in your Apple Wallet when you change your Apple Device or if you provide your Apple Device temporarily to a third party (for example, for repairing purposes;
e) take all security measures to ensure that your mobile and/or Apple Deviceis only authenticated by you and only by you;
f) read all information updates that are notified to you by the Bank from time to time. You shall, in particular, ensure to remain constantly informed of the recommendations and instructions provided on the Bank's website and comply with them with diligence. If you are a Hellenic Bank Wallet user, such instructions and recommendations concern the updating of the parameters related to the Hellenic Bank Wallet and the security of the Hellenic Bank Wallet Contactless Transactions, including but not limited to the indicated actions for the automatic, by going online to the internet, renewal and updating of the necessary "keys", which are required for the conduct of each Hellenic Bank Wallet Contactless Transaction through the connection of the mobile device; 
g) make sure you view the transaction amount on the POS before authorizing a transaction.
6.2. You acknowledge that the poor and/or incomplete implementation of and compliance with this clause may lead to a breach of your Personal Data, as well as to transactions carried out by non-authorized parties. 
6.3. You must immediately notify the Bank by telephone Customer Contact Centre at 8000 9999 (+357 22 500 500 from abroad, without charge), in the following cases:
a) any unauthorized use of your Hellenic Bank Wallet and/or of your Apple Wallet or your Card via Apple Pay;
b) any suspicion of fraudulent activity or data disclosure related to the Hellenic Bank Wallet and/or Apple Wallet itself; 
c) any other actual or potential security breach relating to your Hellenic Bank Wallet and/or Apple Wallet; 
d) the loss or theft of your mobile phone and/or Apple Device; 
e) take all security measures to ensure that your mobile is only authenticated by you and only by you.

Eligibility for subscription to the Hellenic Bank Wallet and/or the Apple Wallet 
7.1. You may only register to your Hellenic Bank Wallet and/or Apple Wallet the applicable Cards that have been issued in your name and you may not allow a third party to register your Card to the third party's Hellenic Bank Wallet and/or Apple Wallet.
7.2. You may not register payment cards or other payment instruments other than Cards to your Hellenic Bank Wallet. 
7.3. Use of the Hellenic Bank Wallet through the mobile application for conducting Hellenic Bank Wallet Contactless Transactions with the use of mobile phones. 
7.4. You may conduct Hellenic Bank Wallet Contactless Transactions at Merchants who hold a Card reader with a contactless (NFC) capability through the Hellenic Bank Wallet App. 
7.5. The Hellenic Bank Wallet requires the use of Android smartphones in which the NFC (Near Field Communication) technology has been incorporated. 

Making Payments
8.1. If you are a Hellenic Bank Wallet user:
8.1.1. In order for the Hellenic Bank Wallet Contactless Transaction to be executed, you must unlock your mobile device, and place it for few seconds at a small distance from the special sensor of the POS terminal of the Merchant, which bears the mark "contactless"
8.1.2. Each Hellenic Bank Wallet Contactless Transaction is completed upon connection of the POS terminal to the Bank's electronic systems, in order to check the digitized card status ("token" status) on Mastercard side and available balance of the Card account in real time and approve the equal charge thereof through the respective indication on the Card reader (accept/deny). Subsequently, the relevant receipt, equivalent to the amount of the transaction which took place, is issued from the POS terminal, and delivered to you. All the approved Hellenic Bank Wallet Contactless Transactions shall appear on the Card's activities in the Hellenic Bank Wallet.
8.1.3. In case you require a refund or in case a dispute relating to a Hellenic Bank Wallet Contactless Transaction arises, you must follow the rules and/or directions as set out by the Cards Terms and Conditions. 
8.1.4. Apart from the above, you may not conduct any other transactions through the Hellenic Bank Wallet, such as cash withdrawal from ATMs or branches and/or internet or telephone transactions.
8.1.5. Analytical information and instructions for the operation and use of the Hellenic Bank Wallet are provided in the Hellenic Bank Wallet App.
8.2. If you are an Apple Wallet user:
8.2.1. When you use Apple Pay in stores for making a Contactless Transaction, you must authenticate payment on your Apple Device using Touch ID, Face ID or your Passcode. When payment is authenticated, your Apple Device provides your Device Account Number to the store’s point of sale (POS) terminal. Your payment information is verified by checking the Device Account Number to ensure it is unique and tied to your Apple Device. Payment can subsequently be made from your bank account.
8.2.2. When you use Apple Pay in apps, Apple Pay receives your Device Account Number and re-encrypts it with a developer-specific key before the transaction information is sent to the app concerned. This key helps to ensure that only the app you are purchasing from can access your encrypted payment information. When your information is verified, payment may then be made from the bank account which is connected to your Card.

Charges 
9.1. The Bank applies no charges for the provision of the Hellenic Bank Wallet or the Hellenic Bank Wallet App. The Bank reserves the right to charge for the provision of Hellenic Bank Wallet App or Hellenic Bank Wallet at any time in the future, by providing notification of the charge in accordance with clause 2.4. Every proposal of the Bank to charge for the provisions of Hellenic Bank Wallet App shall be deemed accepted by you if you fail to notify your non-acceptance before the proposed effective date of the charging. In case of non-acceptance, you are entitled to terminate the Hellenic Bank Wallet in force with the Bank immediately and in any event prior to the proposed effective date of the charging, as provided in clause 10.
9.2. The Bank applies no charges to you in relation to the registration of your applicable Card(s) in the Apple Wallet or your use of the registered Card(s) via Apple Pay and/or the Apple Wallet using the Cards linked to the Apple Wallet. The Bank reserves the right to charge for the above at any time in the future, by providing notification of the charge in accordance with clause 2.4. Every proposal of the Bank to charge shall be deemed accepted by you if you fail to notify your non-acceptance before the proposed effective date of the charging. In case of non-acceptance, you are entitled to terminate the use of your Card from Apple Wallet via Apple Pay immediately and in any event prior to the proposed effective date of the charging, as provided in clause 10.
9.3. The Bank is not liable for any charges your mobile, internet and/or network carrier(s) may charge you for using data on your Apple Device or for any other taxes and costs may exist that are not charged by the Bank.

Data Protection
10.1. You have been provided with the Privacy Notice which describes the manner in which the Bank will process the Personal Data in relation to the processing by the Bank of your Personal Data under applicable law. 
10.2. As applicable, please also refer to Apple’s applicable privacy policy, the Apple Pay & Privacy, and the Apple Pay security and privacy overview which explain how Apple and members of its group process your Personal Data in their capacity of controller, and your rights with respect to such processing.
10.3. You are hereby informed that your Card number, your Cards' expiry date and CVV2 will be transmitted to JCC Payment Systems Ltd, Gemalto (a Thales Company) and Mastercard for the purposes of completing your Card registration to the Hellenic Bank Wallet and/or the Apple Wallet.
10.3. If you have not used Apple Pay for a Card transaction within one month of registering your Card to the Apple Wallet, the Bank will send you a notification reminding you thereof. This communication is performed on the basis of the legitimate interest of Apple to further develop the use of its services.

Termination and Suspension 
11.1. You may terminate the Hellenic Bank Wallet at any time by removing the registered Cards from the Hellenic Bank Wallet or by deleting the Hellenic Bank Wallet App in which case is provided that all the Cards will be automatically unregistered.
11.2. You may terminate the use of your Card/s via Apple Pay at any time by removing the registered Cards from the Apple Wallet. You do so by selecting the relevant Card in the Apple Wallet, then click on the ‘…’ icon in the top right corner to see the Card details. Scroll to the bottom to find the ‘Remove this Card’ option. This will instantly remove the Card from the Apple Wallet. You can also exercise your right to terminate your use of your Card via Apple Pay by contacting us by phone on the telephone number 800 00 800 (+357 22 128000 if you are calling from overseas). In the circumstances set out above, you authorise us to continue to process any outstanding transactions in your Card(s).
11.3. The Bank may immediately suspend or terminate your Hellenic Bank Wallet digitized cards ("tokens") at any time and without prior notice, when it is justified by the following reasons: 
a) you have deleted all your Cards from your Hellenic Bank Wallet;
b) for safety reasons, if you are suspected of carrying out fraudulent transactions through the Hellenic Bank Wallet or/and illegal use of the Hellenic Bank Wallet;
c) upon suspicion of money laundering and terrorist financing;
d) due to a reasonable request of the Card issuer; or 
e) when you breach any of these Hellenic Bank Wallet Terms;
11.4. The Bank may at any time and at its absolute discretion, discontinue or terminate the provision of the Hellenic Bank Wallet App and/or the Hellenic Bank Wallet, by providing you 2 months prior written notice as provided in clause 2.4. above. 
11.5. Τhe Bank may immediately suspend or terminate your registered Cards in your Apple Wallet at any time and without prior notice, when it is justified by the following reasons:
 a) for safety reasons, if you are suspected of carrying out fraudulent transactions through the Apple Wallet or Apple Pay and/or illegal use of the Hellenic Bank Wallet;
 b) upon suspicion of money laundering and terrorist financing;
 c) due to a reasonable request of the Card issuer o/and Apple; or
 d) when you breach any of these Terms for the use of Apple Wallet

Liability
12.1. If you are a Hellenic Bank Wallet user:
12.1.1. You are yourself liable for any damage to your mobile device and linked accessory or any loss of data arising from downloading or using the Hellenic Bank Wallet App, which is not due to the Bank's fault or gross negligence. 
12.1.2. The Bank is not liable for any losses or costs or damage caused by abnormal and/or unforeseeable events which are outside of the Bank's control, which might for example include a machine failing to work or industrial disputes, or resulting from the use of software on your mobile device which has not been officially approved by the manufacturer of the operating system of your mobile device.
12.1.3. The Hellenic Bank Wallet App is provided without any guarantee or assurance of any nature whatsoever in relation to the functionality of the Hellenic Bank Wallet App and the accuracy of the information shown therein. To the fullest extent legally permitted, the Bank is not liable for damage resulting from shortcomings or defects which affect the Hellenic Bank Wallet App or linked accessory, except if such damage has been caused by deliberate recklessness, fraudulent misrepresentation, fault or gross negligence on the part of the Bank.
12.1.4. Subject to clause 11.1.3, despite the Bank having taken all necessary security measures, the Bank cannot be held liable for any losses and/or costs and/or damage that may occur to your computer system, device hardware or software or loss of data that results from the use of the Hellenic Bank Wallet. 
12.1.5. The Bank does not guarantee that the Hellenic Bank Wallet will always be available, uninterrupted and in full operating condition. Access to the Hellenic Bank Wallet may be suspended temporarily and without any prior notice in case of system failure, maintenance or repair or for any reasons beyond the Bank's control. Subject to clause 11.1.3, the Bank shall not be held liable for any suspension, discontinuance, termination, change or modification of your use or access to the Hellenic Bank Wallet.
12.1.7. Subject to clause 11.1.3 but without prejudice to any other limitations of liability as contained in these Hellenic Bank Wallet Terms, the Bank is not liable for any indirect damage and/or loss.
12.1.8. You shall bear all fees, charges, or expenses which may imposed by mobile phone and/or telecommunications service providers for, or in relation to, the installation and/or use of the Hellenic Bank Wallet App. 
12.2. If you are an Apple Wallet user:
12.2.1. You are yourself liable when you breach any of these Terms for the use of Apple Wallet, including but not limited to terms 7.1., or for any damage to your Apple Device and linked accessory or any loss of data arising from downloading or using the Apple Pay, which is not due to the Bank’s fault or gross negligence. 
12.2.2 The Bank is not liable for any losses or costs or damage caused by abnormal and/or unforeseeable events which are outside of the Bank’s control, which might for example include a machine failing to work or industrial disputes or resulting from the use of software on your Apple Device which has not been officially approved by the manufacturer of the operating system of your Apple Device.
12.2.3. The Bank is not responsible for any loss, injury or inconvenience you suffer as a result of a Merchant refusing to accept Apple Pay.
12.2.4. he Bank is not responsible in the event you let another person access your Apple Device and/or register his/her biometrics for Touch ID or Face ID on your Apple Device.
12.2.5. The Apple Pay is provided from Apple without any guarantee or assurance of any nature whatsoever, from the Bank, in relation to its functionality and the accuracy of the information shown therein and which is based to other third parties in order to function, such as mobile, internet and/or network carrier(s). To the fullest extent legally permitted, the Bank is not liable for damage resulting from shortcomings or defects which affect the Apple Pay or Apple Wallet or your Personal Data or the security of your transactions.
12.2.6. Subject to clause 12.2.5, despite the Bank having taken all necessary security measures, the Bank cannot be held liable for any losses and/or costs and/or damage that may occur to your computer system, device hardware or software or loss of data that results from the use of the Apple Wallet. 
12.2.7. The Bank does not guarantee that the Apple Pay or the use of your Card via Apple Pay or the Apple Wallet will always be available, uninterrupted and in full operating condition. The Bank is not liable in the event of an interruption or damage to Apple Pay or Apple Wallet or or your wireless service, communications, network delays, system outages, or interruption of a wireless connection. Access to the Apple Pay or Apple Wallet may be suspended temporarily and without any prior notice in case of system failure, maintenance or repair or for any reasons beyond the Bank’s control. 
12.2.8. Subject to clause 12.2.5, the Bank shall not be held liable for any suspension, discontinuance, termination, change or modification of your use or access to the Apple Wallet.
12.2.9. Subject to clause 12.2.5 but without prejudice to any other limitations of liability as contained in these Terms for the use of Apple Wallet, the Bank is not liable for any indirect damage and/or loss.
12.2.10. You shall bear all fees, charges, or expenses which may imposed by mobile phone and/or telecommunications service providers for, or in relation to, the use of the Apple Pay. 
12.2.11. This clause shall survive any termination of these Terms, howsoever caused.

Waiver
13.1. The Bank's failure to exercise or enforce any right or provision of these Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet will not constitute a waiver of such right or provision. Any waiver of any provision of these Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet will be effective only if in writing and signed by the Bank.

Severability
14.1. If any provision of these Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet is held to be unlawful, void, invalid or otherwise unenforceable, this shall not affect the validity of any other provision of these Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet. In case one or more provisions of these Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet are invalid or become invalid as a result of any changing legislation, the validity of the remaining provisions shall not be affected thereby.

Cypriot Law
15.1. These Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet and any amendments thereto shall be governed by Cypriot Law.
15.2. Any Disputes arising from these Hellenic Bank Wallet Terms or in connection with these Hellenic Bank Wallet Terms and/or these Terms for the use of Apple Wallet that cannot be resolved by means of the internal complaints handling procedure referred to in Basic Terms and Conditions, will be settled by the competent court in Cyprus.
